Car Wreck Victim Obtains Verdict Against State Farm Insurance Company
January 15, 2011 --
Jennifer A. Moore of Grossman & Moore, PLLC recently obtained a jury verdict in favor of her client, Mark Girkey. Mr. Girkey was the victim of a severe automobile wreck in Frankfort, Kentucky. The at-fault driver settled with Mr. Girkey without going to court. Mr. Girkey then turned to his own car insurance company, State Farm Mutual Automobile Insurance Company, to recover his underinsured motorist coverage. However, State Farm refused to fairly and fully compensate Mr. Girkey for his injuries. Mr. Girkey had to file a lawsuit against State Farm and argued that after he timely paid premiums for underinsured motorist coverage that State Farm was contractually obligated to compensate him for his harms. A Franklin County jury returned a verdict for Mr. Girkey and found that State Farm was obligated to pay his past medical expenses, lost wages, and pain, suffering, mental anguish, and incovenience in the amount of $297,936.
